General Terms and Conditions

§ 1 Scope; service for recipients: These terms apply to all contracts about Consent+ with Consensus Ventures GmbH (see imprint). Using Consent+ as a recipient is free of charge; the AI assistant is included for a limited number of trial drafts per month and otherwise part of the paid plan Consent+ Pro (§ 4a). Consents can be withdrawn at any time. Paid services (credits and single deliveries) are offered exclusively to traders within the meaning of § 14 BGB, i.e. companies as well as self-employed persons and freelancers acting in the course of their business or self-employed professional activity. Consumers (§ 13 BGB) cannot purchase paid services.

§ 2 Service for senders: Delivery of an offer to a recipient who invited you via a Consent+ reply. Each delivery costs the price the recipient has set for their account (tiers, see § 4 (6)); it is shown before delivery. In the “Open” tier that is 10 credits (single delivery € 4.90), and the first delivery to such a recipient is free; the other tiers have no free delivery. Before delivery, a traffic light shows the expected fit. If the recipient's filter rejects an offer with a green or yellow light, the credits are credited back in full or the free first delivery becomes available again; for a red light and delivery at your own risk, 0 credits are charged if the offer is rejected. No guarantee of replies.

§ 3 Quality check: Consent+ may reject offers that do not sufficiently match the recipient's topics. Abuse (spam, deception, unlawful content) leads to suspension; offers rejected for abuse are not credited back.

§ 4 Payments, no right of withdrawal, credits: (1) Credit packs and single deliveries are paid at the prices shown when ordering, processed by the payment provider Stripe. (2) Before each purchase you confirm that you are acting as a trader within the meaning of § 14 BGB; we store this confirmation with a timestamp. As you are not a consumer, there is no statutory right of withdrawal. (3) Credits are a balance for Consent+ services. They do not expire, are not transferable and are not paid out as money or refunded to the payment method. (4) If the check rejects an offer with a green or yellow light, or if a delivery fails for technical reasons, you get the attempt back as a credit to your balance or as a renewed free offer, including for single deliveries paid by card. (5) Statutory warranty rights and other mandatory statutory claims remain unaffected. (6) Price per recipient: The recipient sets the delivery price in tiers; it is shown before sending. The relevance check is independent of the price. If the recipient chose a tier with a decision promise and does not decide within 7 days, your credits are refunded automatically.

§ 4b Credit for recipients: Recipients receive 50 % of the value of paid deliveries (at €0.25 per credit) as credit that is only applied to their Consent+ subscription, for tiers with a decision promise only after their decision. It is not paid out, not transferable and not consideration for favouring the sender.

§ 4a Consent+ Pro: (1) Consent+ Pro is a subscription for the AI assistant (reply drafts, automation per category, style learning, drafting and sending via your own agents) at € 29.00 per month or € 290.00 per year, plus statutory VAT, billed in advance via Stripe. Existing subscriptions keep the price agreed when they were taken out. (2) Fair use: up to 400 drafts per calendar month; beyond that, automation pauses until the next month. (3) The subscription renews for the chosen period (month or year) and can be cancelled at any time to the end of the current period in the settings (“Cancel subscription”). (4) Only for traders (§ 14 BGB), see § 4 (2). (5) Drafts are suggestions; you are responsible for what is sent in your name.

§ 4c Invitations: (1) Account holders may recommend Consent+ via their personal link or code. A guest who starts via it receives 90 days of Pro once their mailbox is connected and set up; the inviting person receives 14 days of Pro, and another 30 days once the guest makes their first payment (after a 60-day cancellation period; refunded or disputed payments don't count). (2) The time is given as free Pro or, if the inviting person pays for Pro themselves, as credit against their subscription; at most 365 days per 12 months. There is no cash payout and no legal claim to it; the benefit is a discount on our own service. (3) Each account has only one referral (invitation or partner); a code can be added until the first payment, at most 12 months after sign-up. Own accounts (account group, same payment card) don't count. (4) Mass mailings, spam and misleading statements are not allowed; in case of abuse rewards lapse and the account can be blocked.

§ 5 Final provisions: German law applies. Place of jurisdiction is Munich, to the extent permitted by law.
